The scope of the Rule is not defined by the type of claim so much as it is by the three factors included in the Rule. See paragraph 10 above. So long as those three factors exist, the consideration of whether a representation order should be made is best done within the preferable procedure analysis which includes a consideration of the factors raised in Ginter v. Gardon.
