Justice Zisman sets out the specific language of rule 16 as well as some additional principles in her decision in the case of McCash v. McCash, 2012 ONCJ 503, at paragraph 50. In that paragraph she cites sub rule 16 (1), (4), (4.1), and (6) of the Rules as providing the authority for the circumstances under which the court may grant summary judgment.
