I should also address the maximum contact principle. I agree with the Respondent that this is a critical principle. Indeed, counsel for the Respondent pointed to Gordon v. Goertz (1996 CanLII 191 (SCC), [1996] 2 S.C.R. 27) in support of this principle. However, Goertz also specifically notes that the maximum contact principle is not absolute, and must be considered in light of the children’s best interests.
