In Gordon v. Goertz the court acknowledged that the Divorce Act requires the court to give effect to the principle of maximum contact with both parents, but found that the principle was mandatory, but not absolute. At paragraph 24, the court held that the principle of maximum contact need only be considered to the extent that such contact is consistent with the child’s best interests.
