The “maximum contact” principle is specifically referred to in the Gordon v. Goertz list. However, the caselaw also points out that it is important to remember that the court should consider, and try to preserve as much contact with the noncustodial parent as is consistent with the best interests of the child. In considering the “maximum contact principle”, the courts, quite properly, examine the quality and quantity of the non-custodial parent’s time with the child. Where the children’s contact with the noncustodial parent is limited, or is not particularly beneficial to the children, this principle may become less compelling, if the other best interests factors favour a move.
