Before us it has been suggested by counsel for the appellant that the learned trial judge erred in failing to impose a conditional sentence. As to that, I simply say that the learned trial judge in my opinion certainly made no error in refusing to impose a conditional sentence. As this individual was demonstrating when he was arrested, he was a danger to society in the sense of being involved in persistent trafficking in cocaine. It was in my opinion necessary that he be incarcerated to deter him from this activity and to ensure that he was kept away from sources to feed his addiction. This case in my view is quite different from the case of Regina v. Kozma 2000 BCCA 440, a previous decision of this court cited by the appellant, a case where the individual was by the time of sentence in a stable family situation and well on his way to rehabilitation.
