I find that the elements of the offence of assault causing bodily harm, while related to the offence of sexual assault in the sense that the beatings which the accused administered to the complainant may have terrorized her and deprived her of the will to resist, are not the same as the elements of sexual assault and that a conviction on the latter offence is not in respect of the “same cause or matter”; Keinapple v.
