In the Queen v. Shrubsall, [2002] N.S.J. No. 466, 2002 NSSC 239, the accused was convicted of aggravated assault, choking to enable a sexual assault and unlawful confinement. The complainant suffered bruising, lacerations, double vision, pain and emotional damage. The accused had a lengthy criminal record, including prior convictions for manslaughter and first and third degree sexual abuse convictions in the State of New York.
