The following excerpt is from J & S Hardware Ltd. v. Penner (Ed) Construction Ltd., 1989 CanLII 5089 (SK QB):

In the case of Durham v. Spence, L.R. 6 Ex. 46; and 40 L.J. Ex. 3, two of the judges held that "cause of action" means the act or omission which constitutes the duty complained of and not the whole cause of action, and two others felt that it means the whole cause of action.
