Bove v. Lauritzen, 2009 BCSC 1698, was a situation where the plaintiff moved at trial to take the case out of Rule 66, and the trial took a little longer than two days. The trial judge awarded the cap amount under Rule 66, observing that the trial could have been completed within the two days but for arguments over admissibility of expert opinions.
