On the evidence before me and taking into account the principles in Athey v. Leonati, I find on a balance of probabilities that the plaintiff’s injuries were caused by the motor vehicle accident on March 20, 1998. There is no other explanation which I accept as to the cause of the injury given the evidence of good health prior to the accident, the plaintiff’s track record of hard work during long hours which would have been inhibited had any pre existing physical condition existed.
