The Ontario court in Reed v. Ontario (Registrar of Motor Vehicles), [1966] O. J. No. 563 (H.C.J.), endorsed the approach of Johnson J.A. in Edmonds when interpreting a statute whose wording was the same as Alberta's present statute. There the court stated There is nothing in The Motor Vehicle Accidents Claims Act that supports the proposition that the burden of proof is any higher in actions against the Registrar than in any other negligence action.
