Like the right to counsel, the jury trial guarantee is express and specific. It is one on a rather short list of fundamental protections against arbitrary or oppressive government. Indeed it lies at the heart of the basic compact between individual and society which is the hallmark of our democracy. Thus the right to trial by jury must be honored no matter the cost or inconvenience to government. (Cf. Corenevsky v.
