On June 2, 2009, appellant waived his constitutional right to a jury trial and pleaded guilty to all three counts in exchange for a court offer of a maximum of 32 months in state prison. He admitted the strike prior. Thereafter, on August 24, 2009, appellant filed a motion requesting that the court reduce the felony possession charge to a misdemeanor and dismiss the prior strike under People v. Romero (1996) 13 Cal.4th 497, 529-530. After a hearing, on August 31, 2009, the court denied the motion to reduce the felony possession charge to a misdemeanor, but granted the motion to dismiss the prior strike conviction.
