The parties make no mention of the standard of review in their respective memoranda. I would point out that decisions involving questions of law are subject to the standard of correctness, whereas those involving questions of fact or questions of mixed fact and law are subject to the standard of reasonableness (Housen v. Nikolaisen, 2002 SCC 33 (CanLII), [2002] 2 S.C.R. 235).
