The appellants submit that the errors in this case relate to the failure of the courts below to correctly apply the legal principles they identified, and therefore should be assessed on a correctness standard. The respondent submits that the issues raised by the appellants are matters of mixed fact and law and that there are no extricable questions of law to which the standard of correctness applies.
