The parties are in agreement that the proper standard of review is reasonableness: Dunsmuir v. New Brunswick, 2008 SCC 9. Accordingly, if the decision does not fall “within the range of possible, acceptable outcomes which are defensible in respect of the facts and law” it must be set aside.
