The Sault Ste-Marie subcategory of strict liability offence is a concession to the accused permitting him to raise the defence of reasonable care which was formerly not available to him when the offence was treated as an absolute liability offence. The Strasser v. Roberge subcategory is a concession to the prosecution relieving it of the almost impossible task of proving intent but permitting the accused to negative intenton the balance of probabilities.
