In Byers v. The Queen, supra, the accused was found in the driver's seat of his vehicle, in a field adjacent to the highway, with the keys in the ignition. He was alone. The learned trial judge there, on those facts, found the accused to be in de facto care and control of the vehicle and also found that this accused also had care and control if the presumption applied.
