While the judgment was far less than the offer, the plaintiff says that neither party anticipated the judgment would be that low. The plaintiff maintains the relative financial circumstances of the parties are a significant factor here due to the vast difference in their respective resources. Russell v. Parks, 2012 BCSC 1962, is cited in support of this proposition.
