In Bailey v. Victory, the plaintiff succeeded on a liability issue and recovered judgment substantially in excess of the combined amounts paid into court in advance. The trial judge ordered each party to pay 50% of the other party's costs, with right of set-off, and disallowed entirely the plaintiff’s entitlement to disbursements related to the opinion of a vocational consultant.
