However, the order that the plaintiff is seeking in this motion is much more than implementation and enforcement of the terms of the Settlement Agreement. The plaintiff is seeking a significant amendment to the Settlement Agreement in that the plaintiff wants the date by which claims had to be filed to be changed. I am satisfied that such an amendment is not contemplated by clause 11.3(2) of the Settlement Agreement. The Baxter v. Canada (Attorney General) decision does not assist the plaintiff in that regard.
