It has been held in other jurisdictions with identically worded statutes, that declaring the intent to irrevocably designate a beneficiary in a settlement agreement is a “declaration” within the meaning of the Act, and would result in the beneficiary being irrevocable (Shannon v. Shannon (1985), 1985 CanLII 2026 (ON SC), 50 O.R. (2d) 456 (Ont. H.C.)).
