I need only refer to the remarks of Lord Simon, in the leading case of Steadman v. Steadman, [1974] 2 All E.R. 977, where he says at p. 1002: “A plaintiff alleges an oral agreement. If the defendant does not plead the statute, the plaintiff may prove the agreement by any relevant evidence including oral testimony.”
