All of the parties agreed the appropriate test for the application was not the traditional three-part test set out in RJR‑MacDonald v. Canada (Attorney General), 1994 CanLII 117 (SCC), [1994] 1 S.C.R. 311 for granting an injunction, but rather was the “best interests of the patient” test.
