I am also mindful of the following comments of Justice Pazaratz in Tomlinson v. Hornick, 2008 CarswellOnt 420: Family litigation has become prohibitively expensive, with financial consequences adversity impacting the children the parties purport to protect. Where only one of the parties hires a lawyer, an unfortunate dynamic can arise where the unrepresented party loses track -- or concern -- about ongoing costs. While self-represented parties must be shown consideration and patience, we must be careful not to bend or ignore the rules to such an extent that litigants start to perceive there is a strategic advantage to not hiring a lawyer.
