This was the state of affairs at the time laws against usury were abolished, in 1853 in Canada, and 1854 in England. The legislative history in Canada is set out in the dissenting reasons of Mr. Justice De Grandpré in Construction St-Hilaire Ltée v. Immeubles Fournier Inc., 1974 CanLII 155 (SCC), [1975] 2 S.C.R. 2 at 12-15.
