The enabling legislation is spent. There is no basis to find that the government will adopt the same or similar legislation in respect of a future election or referendum. The possibility that the present issue may arise in the future is too remote to render the present question a live controversy. This was expressed in Zucchiatti at para. 15 and in Maroofi v. College of Physicians and Surgeons of British Columbia, 2017 BCSC 1558 at paras. 74-84.
