Recently, in Tsiaplas v. R, 2021 SKQB 213, it was indicated that section 486.3(3) “is not intended to provide a mechanism to provide a self‑represented party with a lawyer to conduct the cross‑examination of a witness. The focus of the section is not upon the accused. Rather, the focus of the section is upon the witness and the court. The section is intended to provide a mechanism to allow a witness to provide the court with a full and candid account of what occurred and thereby protect the overarching purpose of ensuring the proper administration of justice” (at paragraph 90).
