In Dickhout v. British Columbia (Police Complaint Commissioner), 2011 BCSC 880, Madam Justice Gropper had an opportunity to consider the Police Act. There the issues that were before the court were described in para. 4 as follows: The issues to be determined are: 1. Whether the notice should be set aside on the basis that the commissioner failed to provide reasons for ordering the public hearing; 2. Whether the notice circumvents the October 29, 2010 order of Madam Justice Dickson.
