Garner v. Burr, [1951] 1 K.B. 31, [1950] 2 All E.R. 683 (D.C.), also dealt with the definition of “trailer” in the Road Traffic Act, 1930. The court held that an empty poultry shed fitted with iron bogie wheels was a “trailer” within the Act. Lord Goddard C.J., at p. 33, stated that: “It is true that the justices do not find that anything was carried in the vehicle at the time; but I think that the Act is clearly aimed at anything which will run on wheels which is being drawn by a tractor or another motor vehicle.” Again, this definition is not directly applicable to the present case as it was only necessary to determine whether the poultry shed was a trailer while it was being towed on the highway.
