In Donskoy v. Toronto Transit Commission, 2008 CanLII 47020 (Div. Ct.), the court at para. 16 sounds a caution about routinely dismissing an action at the first status hearing: In other circumstances it may well be a reversible error to dismiss an action at a status hearing for which there are no outstanding orders, and which has come before the court for the first time.
