The following excerpt is from Oberding v. Sun Life, 2011 ONSC 1192 (CanLII):

I reject the plaintiff’s assertion that, in accordance with the Clements v. Greenlaw decision, [2009] O.J. No. 2688, I should not dismiss a plaintiff’s claim at what is, in effect, a first status hearing. The Rules do not provide for a first time pass, especially where defence counsel has put plaintiff counsel on notice that he is taking the process seriously.
