I am hesitant to interfere in the contractual relationship between the parties where they have entered into an agreement in good faith and with clear understanding of the terms of the agreement. Although the suggestion by the counsel for the applicant to include a shotgun clause may be the solution to the problem, it cannot be done unless the applicant meets the requirements as described in Naneff v. Con-Crete Holdings Ltd.
