The application judge also noted the decision of Rutherford J. in Pembroke (City) Police Services Board v. Kidder, supra, in which a thirty-day termination provision for a police chief was struck down, but a ten-year fixed term contract was upheld. In particular, the application judge noted that Rutherford J. "pointed out that a short term might constitute an indirect mechanism to give a board a power of dismissal without reasons or hearing."
