A great deal has been said about prejudice. The officer frankly acknowledged in cross-examination before the board that the delay in getting notice would make no difference in his promotional chances, assuming the board could not have heard the matter earlier. Having regard to the legal right to secure timely compliance with the statutory machinery by bringing mandamus, which succeeded in a different situation in Ramsay v. Toronto (City) Commissioners of Police, supra, the officer's legal assumption seems overly generous to his opponent.
