McLachlin J. (as she then was) in Tataryn v. Tataryn, 1994 CanLII 51 (SCC), [1994] 2 S.C.R. 807 at 823, said: … As between moral claims, some may be stronger than others. It falls to the court to weigh the strength of each claim and assign each its proper priority.
