Counsel for the respondent directed me to the case of Brown v. ICBC, 2004 BCCA 254 at ¶ 12: In many cases, a wilfully false statement which is material to one claim will also be material to another but whether the false statement is material to a claim at risk of forfeiture does not flow from the construction of the statutory provision but from a determination on the evidence in light of the nature of the claim.
