The following excerpt is from Aarnes v. Aarnes, 1929 CanLII 138 (SK QB):

It is further to be observed in the Russell v. Russell case, that it was a judgment of three Judges holding a view which was the adjudication of that tribunal, and two other law Lords dissenting. I very possibly may be in error, but I am determined that if the principle is to be extended further it will not be by me; and I have decided in view of the fact that there is no case going so far as to hold the evidence is not admissible under the circumstances such as are before us in this case that the evidence will not be rejected.
