In general, the law recognizes the right of a party to recover in restitution where another party has been “unjustly enriched” at that party’s expense. Three requirements must be met: there must be an enrichment, a corresponding deprivation and the absence of any juristic reason for the enrichment (Pettkus v. Becker, 1980 CanLII 22 (SCC), [1980] 2 S.C.R. 834).
