In R v. Winsor, supra, a 5 month jail term and a 5 year driving prohibition were imposed on a 39 year old man with no prior record. The accused had been subjected to aggressive driving by the victim. He responded by speeding up in front of the victim and applying his brakes, causing the victim to swerve and crash. He had no prior record and entered a guilty plea.
