The Notice sets out that there is a dispute over the proper interpretation of the applicable pension legislation in force since 1974. Disputes over statutory interpretation, including in the pension context, are recognized causes of action and are certainly justiciable in the courts: see, e.g. Austin v. Bell Canada, 2020 ONCA 142.
