The following excerpt is from Walker v. City of Stratford, 2013 ONSC 7618 (CanLII):

The municipality knew or ought to have known that pedestrians would walk on that part of the highway where the slip and fall occurred. In Ryan v. Stratford (City), at para. 12, the deputy judge stated: “In the case at bar, parking was permitted in the very spot where the plaintiff parked. It would be impossible to access the rear or passenger side of a vehicle without stepping in or near the depression here involved.”
