Non-pecuniary damages compensate for a loss of the amenities, pain, suffering and loss of enjoyment of life. They are intended to compensate a person for those damages up to the date of trial and also for damages that the person will suffer in the future. The award must be fair and reasonable to both parties as set out Stapley v. Hejslet, 2006 BCCA 34, leave to appeal ref’d [2006] S.C.C.A. 100, where Madam Justice Kirkpatrick stated:
