It is as against the foregoing that the criteria of admissibility of expert opinion evidence as set out in Mohan and applied in the civil context in Homolka v. Harris, 2002 BCCA 262 [Homolka], fall to be assessed. The four criteria are relevance, necessity, the lack of any other exclusionary rule, and a properly qualified expert.
