In its draft order the trustee has a provision that any tax refund be paid to the trustee. I thought that Marzetti v. Marzetti, 1994 CanLII 50 (SCC), [1994] 2 S.C.R. 765, definitively settled the status of income tax refunds for bankrupts. I will not go that route again.
