The following excerpt is from USA v. Fleming, 215 F.3d 930 (9th Cir. 2000):
The United States Sentencing Guidelines Manual provides for a two to three point reduction in offense level for a defendant who "clearly demonstrates acceptance of responsibility for his offense." U.S. Sentencing Guidelines Manual S 3E1.1. Fleming contends that the district court erred in concluding that he was ineligible for this reduction in offense level. We review for clear error a district court's decision to deny a reduction for acceptance of responsibility. See United States v. Fisher, 137 F.3d 1158, 1167 (9th Cir. 1998).
At the sentencing hearing, the district court gave Fleming an opportunity to speak. Fleming said,
