The respondent submitted that the payor’s income in the current year is the best evidence because it reflects current circumstances or the current ability to pay. Counsel referred to some decisions where the court had settled on the payor’s current income as the apposite choice for determining Guidelines income: A.R.J. v. Z.S.J., 2009 BCSC 1662, paras. 29 to 30; and Akkor v. Roulston, 2009 BCSC 258.
