In Gordon v. Goertz the court concluded that great respect would be given to a custodial parent’s decision with respect to mobility. Tara’s counsel argued that, while there is no custody order in favour of Tara, the same deference should be accorded to her decision to move, as she acted as the de facto custodial parent of Ethan.
