Engine Block alternatively asks for a constructive trust to be placed on 514. Even if I were persuaded that a constructive trust were an appropriate remedy in this case, perhaps on the basis of Soulos v. Korkontzilas, [1997] 2 S.C.R. 217 (though this case was not argued), it would be a problematic remedy as 514 has gone through various permutations of ownership since these events in 2003.
